Probationary “Red” Licenses
If your driver’s license has been suspended due to a Point Suspension or a Failure to Pay Child Support Suspension, you may be eligible to get a Probationary Red License to allow you limited driving privileges. A Probationary License, if granted, allows for restricted or limited driving privileges, usually including to and from work and to other necessary activities (e.g. doctor appointments and religious functions) as explicitly provided by the DMV. The Probationary License will be cancelled if its restrictions are violated and there will be no driving for the remainder of the restraint period. You may apply for a Probationary License only after your regular license has been suspended by a DMV officer.
Do I Have a Right To Be Granted a Probationary “Red” License?
No. You are not guaranteed to be granted a probationary license — whether you are granted a probationary license depends upon the facts in your case and is in the reasonable discretion of the hearing officer.
Can I Get a Probationary “Red” License if My License is Revoked, Denied or Canceled?
No. You may be eligible for a Probationary “Red” License only if your license has been suspended due to a Point Suspension or a Failure to Pay Child Support Suspension. Drivers under other types of Administrative Suspensions, Revocations, Denials and Cancellations are not eligible for a probationary license.
What If I Violate The Restrictions of the Probationary “Red” License?
If a driver is caught in violation of the restrictions of the Probationary “Red” License, a police officer is authorized by law to take the driver’s license away on the spot. A probationary license may also be taken away by a police officer if the driver commits any moving violation (with an assessment of at least one point) during the period of the Probationary “Red” License.
What Happens if My Probationary “Red” License is Taken Away Due to a Violation?
If your probationary license is taken away because of a violation of the restrictions (e.g. you are caught driving somewhere that is not authorized or you receive a subsequent moving violation conviction), the probationary license is cancelled and you will not be allowed to drive for the remainder of the suspension period. You will also be required to have SR-22 Liability Insurance for three years after you do reinstate once the suspension period ends.
